If you disagree with a decision made by the Registrar about your auctioneer registration, you can appeal to the District Court. This applies if the Registrar refuses to register you as an auctioneer or cancels your registration. You need to tell the court you want to appeal within 20 working days after you find out about the decision. The court might give you more time if you need it.

When the District Court looks at your appeal, they can either agree with the Registrar’s decision or change it. If you’re still not happy with what the District Court decides, you can appeal to the High Court, but only if you think the District Court made a mistake about the law.

22Appeals

  1. A person may appeal to the District Court against the following decisions of the Registrar:

  2. a refusal to register the person as an auctioneer:
    1. a decision to cancel the person's registration.
      1. An appeal must be made by giving notice of appeal no later than 20 working days after the date on which notice of the decision was communicated to the appellant or such further time as the District Court may allow.

      2. In determining an appeal, the District Court may confirm or reverse the decision of the Registrar.

      3. A person may appeal to the High Court from a decision by the District Court under this section on a question of law only.

      4. However, nothing in this section affects the right of any person to apply for judicial review.
