Child Support Act 1991

Voluntary agreements - Procedure on application for acceptance of voluntary agreements

59: Commencement of liability under voluntary agreement

You could also call this:

“When payments start for voluntary child support or domestic maintenance agreements”

When the Commissioner accepts a voluntary agreement for child support or domestic maintenance, the payments start on the latest of these three dates:

  1. The day the Commissioner receives the application.

  2. If the application was first refused but later fixed, the day it was properly made.

  3. The day the agreement says the payments should start.

This means you don’t have to pay until the latest of these dates happens. For example, if you send in your application on May 1st, but the agreement says payments should start on June 1st, you won’t have to start paying until June 1st.
