Contract and Commercial Law Act 2017

Contracts legislation - Minors’ contracts - Agreements relating to trusts

116: Effect of this subpart on trust

You could also call this:

“Explains what trustees and minors can do with trust money and agreements”

This part of the law is about agreements relating to trusts. It explains what trustees and minors can and cannot do.

You need to know that trustees cannot give money or property to a minor (someone under 18) unless the trust allows it. Also, a minor cannot make an agreement that ends a trust or changes how it works.

However, if a contract is approved under section 98 or 117 of this law, it can still work as it’s written, even if it involves a minor or changes to a trust.

Remember, a trust is a legal arrangement where someone (the trustee) looks after money or property for someone else (the beneficiary).
