102: Board to issue practising licence or decline application

When you apply for a practising licence, the Board will review your application. If they think you meet the requirements in section 99, they will do three things. First, they will give you a practising licence for the type of work you’re registered to do. Second, they will send you proof that you have this licence. Third, they will tell the Registrar to add your licence details to the official record.

If the Board doesn’t think you qualify for a licence, they will let you know. They will tell you their decision and explain that you can appeal to the District Court if you disagree.

After the Board approves a licence, the Registrar will add the details to the official record as soon as they can.

102Board to issue practising licence or decline application

  1. If the Board is satisfied that the applicant is entitled, under section 99, to be issued with a practising licence under this subpart, the Board must—

  2. issue to the applicant a practising licence for a class of registration in respect of which that person is registered; and
    1. send to the applicant evidence of the issue of that practising licence; and
      1. direct the Registrar to enter details of that person's practising licence in the register.
        1. If the Board is not satisfied that the applicant is entitled to be issued with a practising licence under this subpart, the Board must notify the applicant of—

        2. the Board's decision; and
          1. the applicant's right of appeal to the District Court against the decision.
            1. As soon as practicable after receiving the Board's direction under subsection (1), the Registrar must enter the details of the practising licence in the register.
