106: Renewal of practising licence

You could also call this:

“How to get your practising licence renewed”

When you want to renew your practising licence, you need to meet certain conditions. The Board will renew your licence if you have done everything required to apply, meet the current standards for registration, haven’t broken any rules of your licence, are a good person to have a licence, and have completed any required competence programmes.

If the Board agrees to renew your licence, they will do so for up to 5 years. They will tell you about their decision and update the register with your new licence details.

If the Board doesn’t think you should get your licence renewed, they will let you know. They will also tell you that you can appeal their decision to the District Court if you disagree.

The Board might overlook small rule breaks when deciding to renew your licence. They can also make you complete a competence programme before renewing your licence, even if you meet all the other requirements.

If you owe the Board any money, they might not renew your licence until you pay what you owe.

Part 10 Registration and licensing of electrical workers and employer licences
Electrical worker registration and licensing: Duration and renewal of practising licence

106Renewal of practising licence

  1. A registered person is entitled to a renewal of his or her practising licence if the Board is satisfied that—

  2. the person has complied with the application requirements in section 105; and
    1. the person complies with the current applicable minimum standards for registration; and
      1. there is no reason to believe that the person has breached any term or condition of the licence during the period before the licence is renewed; and
        1. the person is a fit and proper person to hold a practising licence; and
          1. the person has satisfied the requirements of a competence programme that the person is required to complete under subsection (5).
            1. If the Board is satisfied that the registered person is entitled to a renewal of his or her practising licence, the Board must direct the Registrar to—

            2. renew the licence for the period (not exceeding 5 years) that the Board thinks fit; and
              1. send to the person notification of the Board's decision; and
                1. enter details of the renewal in the register.
                  1. If the Board is not satisfied that the registered person is entitled to a renewal of his or her practising licence, the Board must notify the person of—

                  2. the Board's decision; and
                    1. the person's right of appeal to the District Court against the decision.
                      1. For the purposes of subsection (1)(c), the Board may, if it thinks fit, disregard a breach of a term or condition of the practising licence.

                      2. The Board may require a registered person to complete a competence programme before it renews that person's practising licence (regardless of whether or not the Board is satisfied of the matters referred to in subsection (1)(a) to (d)) if the person is required to complete a competence programme when applying for a renewal of the licence in accordance with a condition or requirement imposed by a notice published under section 85.

                      3. Despite subsection (1), if any fee or other money payable to the Board under this Act by the registered person has not been paid, the Board may refuse to renew that person's practising licence until that fee or other money is paid.
