This grant is available if you were supposed to get it before 1 April 2002 but didn’t receive it. The injury must have been covered by the accident compensation laws at that time.

If someone in your family died before 1 July 1992 because of an accident, different rules apply. These rules are from an older law called the Accident Compensation Act 1982. They cover lump sum payments for spouses or partners, children, and other people who depended on the person who died.

The Corporation (ACC) will look at who depended on the person who died to decide who gets the payment. This applies to deaths that happened before 1 July 1992.

382Survivor's grant to surviving spouses or partners, children, and other dependants for death before 1 April 2002

  1. On or after 1 April 2002, a survivor's grant is payable under clause 65 of Schedule 1 if—

  2. a person died on or after 1 July 1992 and before 1 April 2002 as a result of personal injury covered by the Accident Rehabilitation and Compensation Insurance Act 1992 or the Accident Insurance Act 1998; and
    1. a survivor of that person is entitled to be paid a survivor's grant before 1 April 2002; and
      1. the Corporation has not paid a survivor's grant to that survivor before 1 April 2002.

        1. If a person died before 1 July 1992 as a result of personal injury by accident within the meaning of the Accident Compensation Act 1982, section 82 of that Act, and the provisions of that Act on dependency, as they relate to lump sums payable under that section, apply to any spouse or partner, child, or other dependants of the deceased person.
